Compulsory acquisition

The only enduring solution to the community safety risks associated with the existence of loose fill asbestos in the ACT’s residential housing stock is the demolition of all affected properties. While not the preferred option, the ACT Government acknowledges that it may need to undertake compulsory acquisition actions for any affected properties remaining privately owned from either mid-2025 or two years after the property is added to the Affected Residential Premises Register, whichever is later.

The ACT Government will work closely with homeowners prior to any compulsory acquisition action being commenced and will consider the individual circumstances of each homeowner and resident.

Any compulsory acquisition undertaken will be in accordance with the requirements of the Lands Acquisition Act 1994.
