Rebuilding


When you rebuild on a remediated block that has been removed from the Affected Residential Premises Register (whether it was part of the Loose Fill Asbestos Insulation Eradication Scheme or demolished privately), the work is subject to the normal development application (DA) processes overseen and approved by the Environment, Planning and Sustainable Development Directorate.

Special planning considerations

A Territory Plan Variation 343 (V343) allows dual occupancy and unit titling rights for some affected blocks surrendered as part of the buyback program.

Trees on the block

Remaining trees on the block may be protected under the Urban Forest Act 2023 as a ‘regulated’ or ‘registered’ tree. More information on trees on private land can be found at City Services.

ACT Government led redevelopments

Where the ACT Government is planning to rebuild on a block that is Unit Titled and/or comprises of a shared party wall with a non-affected property, additional consultation and authorisation steps will be undertaken with the relevant surrounding residents, Strata Management firm and Owner Corporation members prior to commencement of works. The Loose Fill Asbestos Response team will ensure all relevant parties are kept appropriately informed and all requirements as per the Unit Titles (Management) Act 2011 are met.
