Private demolition and sales


Homeowners may decide that the private demolition or private sale of their affected property may be more appropriate for their individual situation, and the Loose Fill Asbestos Coordination team is supportive of these options.

Private demolition

If a homeowner decides to pursue the option of private demolition, it is their responsibility to engage a suitably qualified contractor and a licensed asbestos assessor to conduct the work.

Homeowners must disclose the property contains loose fill asbestos insulation when engaging a licensed contractor. A Class A licensed asbestos removalist must be engaged to remove the asbestos from the property, and all stages of the demolition process must comply with the Work Health and Safety Act 2011 and the Dangerous Substances Act 2004.

Once a property has been demolished and remediated, the property can be removed from the Affected Residential Premises Register (Register) provided it meets deregistration requirements.

Private sale

When selling an affected property, homeowners must disclose that the property is notified on the Register and contains loose fill asbestos insulation to any prospective buyer.

Note: If you purchase a property that is listed on the Register, you are not eligible to participate in the buyback program. Only the owner (or owner’s estate) of the affected property at the time the property is added to the Register is eligible.

Occupancy prohibition

If buying or selling a property affected by loose fill asbestos insulation, it is important to be aware that an occupancy prohibition prevents affected properties from being occupied following either a transfer of ownership or the expiration of a current rental or subletting agreement. An approved occupant is exempted from this occupancy prohibition.
